Recommendation:  That the Common Council adopt Resolution No. 10659-073106, which would approve the development agreement with Opus North Corporation for the construction of public improvements for their property in the Oakwood Crossings Business Center Phase II, at 10101  S. Howell Avenue (Tax Key No. 924-9006-002) (Project No. 06063) ) (5^th Aldermanic District).

Background:  Opus North Corporation is proceeding with a Phase II development in the Oakwood Crossings Business Center.  The proposed development is a distribution facility for Corporate Express at 10101 S. Howell Avenue.  This agreement will provide the City with the authority to direct and control the design and construction of the necessary public improvements to ensure they meet City codes and specifications.

Fiscal Impact:  None.  Developer funded.

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

OPUS NORTH CORPORATION

FOR

OAKWOOD CROSSINGS BUSINESS CENTER PHASE II

(5^th ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Opus North Corporation, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
