Recommendation:  That the Common Council adopt Resolution No. 10658-073106, which would approve the future improvements agreement with Cartison, Inc. and Petrelli Development, LLC addressing future ultimate improvement and potential assessments affecting the Cartison-Petrelli Certified Survey Map (CSM) (Tax Key No.  862-9995-001) (3^rd Aldermanic District).

Background:  Cartison, Inc. and Petrelli Development, LLC propose to develop a three lot and one outlot CSM at the southeast corner of E. Puetz Road and S. Nicholson Road.

It is impractical to install full public improvements under this development.  Thus, as a condition of approval of this CSM, the City is requiring the Developer to sign a future improvement agreement addressing the installation and assessment of the ultimate improvements affecting this CSM.  The ultimate improvements for this CSM’s RS-3 zoning is storm sewer, storm channels, downstream storm drainage improvements, concrete curb and gutter, street lights, street trees and sidewalk.  This agreement will be recorded with Milwaukee County Registrar of Deeds, which will assure that future property owners will be informed of this future improvement assessment requirement attached to the property.

Fiscal Impact:  None currently.  Impacts future development.

RESOLUTION APPROVING THE

FUTURE IMPROVEMENTS AGREEMENT WITH

CARTISON, INC. AND PETRELLI DEVELOPMENT, LLC

(3^rd ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Future Improvements Agreement attached hereto and incorporated herein by reference, by and between Catison, Inc. and Petrelli Development, LLC, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
