Recommendation:  That the Common Council adopt Resolution No. 10657-073106, which would approve the compensating storage development agreement with Cartison, Inc. and Petrelli Development, LLC for the grading and construction of compensating storage at S. Nicholson Road and E. Puetz Road for the Cartison-Petrelli Certified Survey Map (CSM) (Project No. 06065) (3rd Aldermanic District).

 

Background:  Cartison, Inc. and Petrelli Development, LLC are proposing a three-lot and one outlot CSM at the southeast corner of E. Puetz Road and S. Nicholson Road. Before the City will release the CSM for recording, the Developers must complete a grading plan approved by the Engineering Department, including compensating volumes of earthwork to accommodate the proposed lots.  Public sanitary sewer and water main is available for all proposed lots.

 

Fiscal Impact:  None.  Developer pays for all improvement costs.

RESOLUTION APPROVING THE

COMPENSATING STORAGE DEVELOPMPENT AGREEMENT WITH

CARTISON, INC. AND PETRELLI DEVELOPMENT, LLC

 

(3rd ALDERMANIC DISTRICT)

 

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

 

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Cartison, Inc. and Petrelli Development, LLC, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 31st day of July, 2006.
