Recommendation: That the Common Council adopt Ordinance No. 2409, an ordinance to repeal and recreate Section 14.101(f) of the Municipal Code regarding future public improvements.
Background: This ordinance would require developers to enter into an agreement with the City related to the cost of future public improvements (which cannot be practically installed at the present time) as a condition of approval of a land division. The agreement would require developers to execute a “Waiver of Special Assessment Notices and Hearings” for the ultimate improvements, and would affect their successors. This document would be recorded against the property and serve notice to potential acquirers that substantial future costs are a possibility.
A draft of the “Agreement Related to the Cost of Future Public Improvements” is attached for information.
