RESOLUTION APPROVING A PRELIMINARY
CERTIFIED SURVEY MAP FOR CARTISON, INC. and PETRELLI INC
(3rd Aldermanic District)
WHEREAS, it appears that the certified survey map submitted by CARTISON, INC. and PETRELLI INC., hereinafter referred to as the subdividers, is in compliance with all statutory requirements; and
WHEREAS, the subdividers have complied with all of the applicable ordinances and resolutions of the City of Oak Creek, and
WHEREAS, the Plan Commission, at their meeting of February 14, 2006 has recommended that this certified survey map be approved subject to the following conditions,
1. That a development agreement is entered into between the owner and the City to specify the responsibility for and timing of any required public improvements.
2. That all technical corrections are made prior to recording including showing the existing watermain easement along S. Nicholson Road and additional right-of-way dedication.
3. That the final grading plan is approved by the Engineering Department prior to recording.
4. That the certified survey map is not recorded until the City has approved the flood volume compensation and has received certification form the Wisconsin Department of Natural Resources and Federal Emergency Management Agency (FEMA).
5. That any technical corrections are made, including there be no access to Puetz Road.
and,
WHEREAS the Engineering Department has determined that no public improvements are required to service this land division; and,
WHEREAS Chapter 14.101(f) of the Municipal Code requires that the subdivider of certain parcels enter into an agreement with the City related to the cost of future public improvements; and,
NOW, THEREFORE, BE IT RESOLVED that this certified survey map, in the City of Oak Creek, Wisconsin, is hereby conditionally approved by the Common Council, and the dedication accepted.
BE IT FURTHER RESOLVED that this certified survey map shall not be recorded until such time as an agreement is recorded relating to the cost of future public improvements for the parcels; and,
BE IT FURTHER RESOLVED that Outlot 1 is not buildable, and that this outlot will be converted to a buildable lot upon approval of a floodplain map amendment, and the recording of a subsequent certified survey map whose approval and recording will not take place until such time as the City has approved the flood volume compensation and has received certification from the Wisconsin Department of Natural Resources and FEMA and that all improvements are in.
