Recommendation:  That the Common Council consider a motion to award the 2006 Road Improvements unit price contract to the lowest responsive, responsible bidder, Payne & Dolan, Inc., at an estimated cost of $716,388.00 (Project Nos. 06015 through 06020).

 

The recommended motion includes:

 

1.                  Rejecting the bid received from Wm. Beaudoin & Sons and returning their bid bond at their request (see attached letter dated April 21, 2006) due to an error in how their Alternate “A” bid was added.  Their intended Alternate “A” bid was $834,656.25.

 

2.                  Waiving the bid irregularity of Payne & Dolan, in which they did not acknowledge Addendum No. 2 on the bid form.  Refer to City Attorney Haskin’s memorandum dated April 26, 2006.

 

Background:  The Common Council adopted Resolution No. 10611-030706, approving the project on March 7, 2006.  The Engineering Department prepared the plans and specifications for the project and the work was advertised.  This is a unit price contract.  Thus, the bids were evaluated based on estimated quantities.  Three bidders submitted the following:

The work was bid two ways.  The standard bid work entails constructing the 6” thick asphalt pavement in three lifts.  This is the way the City has been constructing roads for the past several years because constructing in three lifts assures good pavement density and staggering of seams.  The Alternate “A” Bid work entails constructing the 6” thick asphalt in just two thicker lifts.  The alternate bid was put in the bid documents to determine if the trade-off of faster construction, but also greater effort to assure adequate pavement density, would result in significant savings in the bid.  It is the Engineering Department’s opinion that the trade-off is not worth the less than 2% savings.

 

Fiscal Impact:  There is approximately $300,000 in the “Unspecified Streets” control account left over from past paving projects, and $500,000 budgeted for in the 2006 CIP, for a total of about $800,000 available for this year’s paving program. Also, the City and WE Energies have an agreement whereby WE Energies will reimburse the City for the construction costs of the Oakwood Road improvements.
