Recommendation:  That the Common Council adopt Resolution No. 10633-050206, which would approve the development agreement with Kayrich Properties, LLC, (Developer) for the installation of public water main that will accommodate their building expansion plans for Columbia Grinding at 7411 S. 10th Street (Tax Key Nos. 764-9021 and 764-9024) (City Project No. 06056) (1st Aldermanic District).

 

BackgroundColumbia Grinding is proposing to expand their existing facility at 7411 S. 10th Street.  The proposed expansion necessitates the installation of 250 feet of 12” public water main and a new fire hydrant. It will also require the construction of storm water detention facilities. This agreement will provide the City with the authority to direct and control the design and construction of the required public water main to ensure they meet City codes and specifications.

 

Fiscal Impact:  None.  Developer pays for all design and installation costs.

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

KAYRICH PROPERTIES, LLC

(COLUMBIA GRINDING)

 

(1st ALDERMANIC DISTRICT)

 

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

 

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Kayrich Properties, LLC, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 2nd day of May, 2006.
