Recommendation: That the Common Council discuss and respond to a developer’s request to reduce the sidewalk requirements for Oak Leaf Estates development (Project No. 05035) (6th Aldermanic District).
Background: The original development agreement for Oak Leaf Estates (condominium development south of Kohl’s) was entered into on August 1, 1995. As a requirement of this development, sidewalk was to be installed on at least one side of all public streets. Prior to the installation of the sidewalks, residents of the development appeared before the Council to argue against sidewalk installation. The reasons given were numerous including walking in the streets is safe, the cost of winter maintenance was high, the developer told them he would donate the saved money to the City, etc. The Council agreed in principle to remove the sidewalk requirements except those connecting the first two buildings (north and south side) to S. Howell Avenue. The council directed staff to negotiate an amendment to the development agreement. During those negotiations, Michael D. Rosen agreed to the reduced sidewalk installation, but would not agree to give the City the avoided costs. On January 15, 2002, the Council approved the amendment. Subsequent to this approval, a group of citizens petitioned the City to install “no parking” signs at various locations, because it had become unsafe to walk in the road. The Council denied this
Mr. Rosen is now requesting that another amendment be approved that would allow him to install a wider sidewalk only on the north side of W. Oak Leaf Drive. His reasons are that it would be difficult and expensive to construct the south side extension. This request does not respond to the needs of handicapped residents that lived there in 2002.
If the Council considers approving this request, additional sidewalk along S. Aspen Drive would have more value than a wider section in a small area. By the end of the construction year, S. Aspen Drive will be connected to W. Centennial Drive. The section behind Kohl’s and Target will have sidewalk installed.
