Recommendation:  That the Council adopt Resolution No. 10634-050206 approving a certified survey map for the Parkway Apostolic Church at 10820, 10940, & 10970 S. Nicholson Road

 

Background:  Parkway Apostolic Church is requesting approval of a certified survey map that would combine two parcels and move a property line on land owned by the Church.  Lot 1 would be 8.4 acres and is currently zoned Rs-2, Single Family Residential. Lots in the Rs-2, Single Family Residential Zoning District require a minimum of 100 feet in width and 17,000 square feet in lot area.  The Rs-2 portion of the CSM exceeds this requirement.

 

Lot 2 would be 13.4 acres and would remain the church site.  This property is zoned I-1, Institutional though a portion of this property will remain Rs-2, Single Family Residential.  Institutionally zoned properties must provide sufficient area and width for the principal structure(s) and its accessory structures off-street parking and loading areas, and required setbacks.  Staff believes that there is more than sufficient land for the existing church operations given the size of the parcel.

 

The Plan Commission has reviewed the proposed CSM and has recommended its approval.

 

Fiscal Impact: These properties are tax exempt.  The property at 10820 S. Nicholson Rd. has three outstanding deferred special assessments under project #80015 as follows:     sanitary sewer-$8,400.00, water main-$7,600.00 and a sanitary lift station-$2,980.00.

 

There is a development agreement from 1993 for a CSM done that created three parcels and the assessments were divided between the three and parcel 2 & 3 were paid, but parcel 1 was due upon sale of the parcel, which was $23,480.00, then they paid the 4500.00 for the house in 1999, which leaves the balance of $18,980.00.  The Resolution states that these assessments become due and payable from the date of approval of a final plat or certified survey map of any portion of the premises.
