City of Oak Creek

Common Council Report

Meeting Date3/21/06

Item No.:

Recommendation:  The License Committee is scheduled to meet on Tuesday, 3/21/06, immediately prior to the Council meeting.  Tentative recommendations are being made at this time as follows:

1.         Grant an original Class B Combination license:

Melrose Eatery, Inc., Konstantinos (Gus) Spyropoulos, Agent, for Judy’s Family Restaurant, 6840 S. 27th St., with issuance subject to receipt of Wisconsin Seller’s Permit Number, Federal ID Number, payment of fees, receipt of certificate of responsible beverage class for the agent, and receipt of an occupancy permit.

A recent sale of this property has taken place.  The new owners applied for a Class B Combination license and, as allowed by state law, a provisional license issued on 2/23/06.  The provisional license is valid for 60 days or until their regular license is granted and issued.  They are currently operating for approximately the next two to three weeks and will then close for remodeling.  The remodeling will take approximately two to three months to complete.

The State Health Inspector made a recent re-inspection of the site for compliance with code violations found in December 2005 under the old ownership, and found that those violations were still outstanding.  A meeting was held at City Hall with the state inspector, City Sanitarian and Deputy Health Officer and the new owners to discuss the violations.  The new owners were not aware of those violations, but did make some repairs the same day and their intent is to continue to make corrections, with any outstanding issues completed during remodeling.  All internal processing is complete, except for sign-off by the Sanitarian.  I spoke with John DeVita and because they have already corrected numerous items and will soon be closed for remodeling, he had no problem in recommending that a license be granted to the new owners, with issuance subject to the occupancy permit that will be issued upon completion of remodeling.
