Recommendation:  That the Council adopt Resolution No. 10616-032106, approving a certified survey map for the property at 2327 Ryan Road.

 

Background:  The applicant is requesting approval of a certified survey map that will revise access easements between this property and the property to the west at 2345 W. Ryan Road.  The current restrictions prohibit any vehicle in excess of 10,000 pounds or any tractor trailers from using the easement to enter onto adjacent properties.  Additionally the existing easement only is valid if the adjacent parcels are used for retail.  The applicant has come to an agreement with the Oak Creek Commons retail center, currently under construction to the west, and is eliminating these two restrictions. 

 

The City Attorney has advised staff that since these restrictions are on the face of a recorded certified survey map that a new map is the appropriate way to amend them. This certified survey map will not create any additional lots or alter any property lines.

 

The Plan Commission has reviewed this request, and recommended its approval.

 

Fiscal Impact:  There will be no fiscal impact as a result of this certified survey map. There are no outstanding special assessments on this property.
