RECOMMENDATION: That the Common Council adopt Resolution No. 10607-020706, a resolution approving an amendment to the Oakwood Crossings Business Center-Phase I  Development Agreement, outlining responsibilities between Opus North (Developer) and the City of Oak Creek (City) as they relate to the Memorandum of Understanding (MOU) between Wisconsin Department of Transportation (WisDOT) and the City for improvements to the Oakwood-Howell Avenue (STH 38) intersection. (Project No. 03054) (5th Aldermanic District).

 

BACKGROUND:  At the time of approval and signature for the Oakwood Crossings Business Center – Phase I development agreement, provisions were included that outlined responsibilities for the City and Developer for improvements to the Oakwood-Howell Avenue intersection and peripheral areas.  Since approval of the agreement, negotiations between the City, Developer and WisDOT have concluded with an MOU between the City and WisDOT on responsibilities for the Oakwood-Howell Avenue intersection and additional financial obligations.  In turn, it is now necessary for the City and Developer to amend the original agreement to include the current right-of-way, and the financial and construction responsibilities of the Developer..     

 

FISCAL IMPACT: The MOU imposes certain right-of-way, financial and construction responsibilities upon the City, which, in turn, are imposed on the Developer via the amended agreement.

RESOLUTION AMENDING THE DEVELOPMENT AGREEMENT

 

OAKWOOD CROSSINGS BUSINESS CENTER – PHASE I

            WHEREAS, Opus North Corporation, hereinafter referred to as the “Developer”, and the City, wish to amend the Oakwood Crossings Business Center development agreement, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Development agreement for the Oakwood Cros sings Business Center – Phase I is hereby amended and approved.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 7th day of February, 2006.

 

            Passed and adopted this 7th day of February, 2006.
