Recommendation:  That the Common Council adopt Resolution No. 10606-020706, which would approve the development agreement with McAdams Graphics, Inc., (Developer) for the installation of public water main that will accommodate their building expansion plans (Tax Key No. 765-9986) (City Project No. 06051) (1^st Aldermanic District).

Background:  McAdams Graphics, Inc. is proposing to expand their existing facility at 7200 S. 1^st Street.  The proposed expansion will necessitate the relocation of a public water main to accommodate their new storm water piping system.  It will also require the construction of storm water detention facilities. This agreement will provide the City with the authority to direct and control the design and construction of the required public water main to ensure they meet City codes and specifications.

Fiscal Impact:  None. Developer pays for all design and installation costs.

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

MCADAMS GRAPHICS, INC.

(1st ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between McAdams Graphics, Inc., as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
