Recommendation:  That the Common Council adopt Resolution No. 10604-020706, which would approve the development agreement with Cary and Lori A. Schmidt for the construction of public sanitary sewer and water main for their property at 9160 S. Pennsylvania Avenue (Tax Key No. 871-9997) (Project No. 06050) ) (3rd Aldermanic District).

 

Background:  Cary and Lori A. Schmidt are proposing to build a dance studio on their property at 9160 S. Pennsylvania Avenue.  Construction of the dance studio requires the extension of public sanitary sewer and water main per Section 14 of the Municipal Code.  This agreement will provide the City with the authority to direct and control the design and construction of the necessary public sewer and water main extensions to ensure it meets City codes and specifications.

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

CARY AND LORI A. SCHMIDT

 

(3rd ALDERMANIC DISTRICT)

 

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

 

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Cary and Lori A. Schmidt, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 7th day of February, 2006.
