Recommendation:  That the Common Council adopt Resolution No. 10595-020706, which would approve the development agreement with Anthony S. Sanfelippo for the construction of a permanent cul-de-sac to E. Kender Lane.

Background:  Anthony S. Sanfelippo is proposing to improve three existing single family parcels, of CSM No. 6464, at the western terminus of E. Kender Lane.  For this to occur, Mr. Sanfelippo must construct a permanent cul-de-sac extension, per Section 14 of the Municipal Code.  This agreement will provide the City with the authority to direct and control construction of the cul-de-sac, and the required public sanitary sewer, water main and storm sewer improvements to ensure they meet City codes and specifications.

Fiscal Impact:  None.  Developer pays for all improvement costs.

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

ANTHONY S. SANFELIPPO

(3rd ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Anthony S. Sanfelippo, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
