Recommendation:  That the Council adopt Ordinance No. 2438, which would rezone portions of the properties at 4201 E. Fitzsimmons Road and 10150 S. Chicago Road that are currently zoned Rm-1, Multifamily Residential and Rs-1, Single Family Residential.

 

Background: In 2005 the Common Council rezoned these properties from A-1, Agricultural to Rs-1, Single Family and Rm-1, Multi-Family Residential for the Bluffs of Oak Creek Subdivision.  The preliminary plat was approved by the Plan Commission on December 16, 2005.  During the engineering and design work it was discovered that there were some areas of overlap between the Rs-1, Single family zoned portion and the Rm-1, Multi-family district.  The applicant is now requesting some minor changes in the zoning boundary to accommodate the design modifications.  This request does not change any of the plans submitted by the applicant for the Bluffs of Oak Creek Subdivision; it only modifies some of the zoning boundaries within the development.

 

Exhibit A, included with this staff report, illustrates the minor zoning changes that are being proposed.  The applicant has also provided a map of the entire development with the zoning changes highlighted and a letter explaining why they are requesting this.

 

The Plan Commission has reviewed this request, and has recommended its approval.

 

Fiscal Impact:  The adjustment of the zoning of these properties would have no fiscal impact.
