Recommendation: That the Council adopt Ordinance No. 2432, which would rezone part of the properties at 2234 and 2298 E. Elm Road from Rs-3, Single Family Residential to A-1, Agricultural.
Background: The owner of the recently combined properties at 2234 & 2298 E. Elm Road is requesting that the City rezone the front approximately 260 feet of each property from Rs-3, Single Family Residential to A-1, Limited Agricultural. The majority of the parcel is zoned A-1, Agricultural, with the exception of the front portion, which was rezoned as part of a City-wide rezoning in 1995. The parcel is currently being farmed and the applicant would like the entire parcel zoned A-1 so he can construct a new farm structure towards the front of the property.
The applicant combined the properties into one to accommodate this rezoning as the eastern parcel would not have met the area and lot width requirements of the A-1, Limited Agricultural District, which requires a minimum lot area of 5 acres and a minimum lot width of 150 feet. Now that the parcels have been combined the lot has 222.23 of lot width and 6.6 acres, exceeding the required minimums.
At the Plan Commission meeting, a letter was read into the record from a nearby property owner raising several issues (see attached minutes). Staff’s research into those issues, and a response are included in the attached report.
Fiscal Impact: The zoning of the property would have no fiscal impact, although the use of the property for agricultural purposes may have implications on its assessed value.
