RESOLUTION APPROVING A CERTIFIED SURVEY MAP
FOR REINHART REAL ESTATE GROUP, INC. AND LONE OAK – OAK CREEK, LLC
9950 S. 27th Street and 9925 S. Reinhart Drive
(6th Aldermanic District)
WHEREAS, it appears that the certified survey map submitted by the REINHART REAL ESTATE GROUP, INC. AND LONE OAK – OAK CREEK, LLC
hereinafter referred to as the subdividers, is in compliance with all statutory requirements; and
WHEREAS, the subdividers have complied with all of the applicable ordinances and resolutions of the City of Oak Creek, and
WHEREAS, the Plan Commission has recommended that this certified survey map be approved, subject however to the condition that a development agreement be entered into between the owner and the City to specify the responsibility for, and the timing of public improvements
NOW, THEREFORE, BE IT RESOLVED that this certified survey map, in the City of Oak Creek, Wisconsin, is hereby approved by the Common Council.
BE IT FURTHER RESOLVED that any development on Lot 1 requires the dedication and improvement of the public street as illustrated on the official map or any amendment thereto;
BE IT FURTHER RESOLVED that the owners of Lot 1 shall enter into a development agreement with the City of Oak Creek for the dedication and improvement of the public street extension of South Reinhart Drive through to South 27th Street (STH 241) in accordance with the official map, or any amendments thereto to conform with the 27th Street Access Management Plan or other alignment approved by the Wisconsin Department of Transportation.
BE IT FURTHER RESOLVED that in the event that the owners of Lot 1 do not enter into a development agreement with the City Oak Creek for the dedication and improvement of public streets by January 1, 2008 that the owners of Parcel 1 of CSM 5814 will be responsible to construct and dedicate all needed improvements within South Reinhart Drive from its existing terminus to a point approximately 409.11 feet to the south, as identified as the lands proposed to be dedicated to the City by this certified survey map. This includes construction of a temporary turn around meeting the design standards of the City within the temporary cul de sac easement.
