Recommendation:  That the Council adopt Resolution No. 10693-101706 approving a certified survey map for the Howell Oaks Retail Center (Demco Wisconsin 1, LLC) for the properties at 8201 & 8261 S. Howell Avenue. 

 

Background:  The applicant is requesting approval of a certified survey map that would split the Howell Oaks retail development property into 3 lots. Back in April of 2002, the Plan Commission approved a two-lot certified survey map for this property.  On October 4, 2005 the Common Council conditionally approved the map, subject to it being held from recording until certain public improvements spelled out in the Development Agreement were installed.  The applicant is now requesting a revision to the CSM that would split the property into three (3) lots instead of two (2).

 

The newly created Taco Bell property (Lot 3) will be 41,796 square feet (.96 acres), Lot 2 will be 36,131 square feet (.83 acres), and Lot 1, the Howell Oaks Retail Center, will be 451,890 square feet (10.38 acres).  Parcels in B-4, Highway Business district require a minimum of 150 feet of lot width and 30,000 square feet in area.  The newly created parcels exceed this requirement. After the split, Lot 1 will have 36 percent greenspace, Lot 2 will have 31 percent, and Lot 3 will have 38 percent, therefore all properties meet the 30 percent greenspace requirement. An ingress-egress easement is provided to allow access to lots 2 and 3.

 

The Plan Commission has reviewed this request and has recommended its approval.

 

Fiscal Impact:  Future retail development on Lot 2 will have a positive fiscal impact for the City.  There are no outstanding assessments on this property.
