Recommendation:  That the Common Council adopt Resolution No. 10691-101706, a resolution granting right-of-entry onto City of Oak Creek property, to Foran Spice for the  construction of access road side slopes and to thereafter maintain said side slopes, all at 7616 S. 6^th Street (Tax Key No. 782-9027-001) (1^st Aldermanic District).

Background:  Foran Spice, at 7616 S. 1^st Street, is expanding their facility and proposing an access road on the north side of the building. The proposed access road will abut the existing drainage channel which is in and on City property.  As proposed, the side slopes for the access road will encroach onto the drainage channel right-of-way, owned and maintained by the City.  The attached drawings show that this may be accomplished, using 3:1 side slopes, which do not infringe on or into the 100-year flood way.  Allowing this right-of-entry to construct and maintain the side slopes eliminates the extensive and costly requirement of erecting a retaining wall.  

Fiscal Impact:  None. Foran Spice pays for all new construction and ensuing yearly side slope maintenance costs.

RESOLUTION APPROVING RIGHT-OF-ENTRY TO FORAN SPICE

FOR CONSTRUCTITION AND MAINTENANCE OF ACCESS ROAD SIDE SLOPES

AT 7616 SOUTH 6^TH STREET

TAX KEY NO. 782-9027-001

(1^ST ALDERMANIC DISTRICT)

            WHEREAS, Foran Spice wishes to construct an access road on the north side of their facility at 7616 South 6^th Street, Tax Key No. 782-9027-001,and

            WHEREAS, construction of said side slopes will encroach into and upon City right-of-way, and

            WHEREAS, said side slopes will not infringe upon existing 100-year floodway.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that Foran Spice, at 7616 South 6^th Street, is hereby granted right-of-entry onto City right-of-way to construct and thereafter maintain access road side slopes.

BE IT FURTHER RESOLVED that the City Attorney is authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
