Recommendation: That the Common Council adopt Resolution No. 10692-101706, authorizing a payment of $8,000 to Mid-America Steel Drum, Inc. related to the proposed vacation of the Edison Road right-of-way. Payment is not to be made until the vacation of the right-of-way is completed. (Tax Key No. 822-9979) (4th Aldermanic District).
Background: The City has been trying to vacate Edison Road for a number of years. It serves just one adjacent property owner, Mid-America Steel Drum (MASD). If the right-of-way is vacated, the pavement will become a private driveway for MASD. The City will no longer be responsible for plowing and maintaining the pavement. Because the road has been in very poor condition for several years, MASD has requested that the City repave the road prior to vacating the right-of-way. Based on the current 2006 paving contract prices that the City has with Payne & Dolan, this would cost approximately $8,000.
If MASD would take the $8,000 payment in lieu of the City repaving the road, the City would save construction management costs as well as potential warranty follow-up. MASD could then hire their own contractor to repave the vacated road along with the pavement on their private property in a uniform, consistent and continuous manner to better suit their needs as a private entrance for their business.
Fiscal Impact: The payment of $8,000 would come from available funds in the 2006 “Unspecified Streets” account.

RESOLUTION AUTHORIZING
A PAYMENT OF $8,000 TO
MID-AMERICA STEEL DRUM, INC.
(4TH ALDERMANIC DISTRICT)
BE IT RESOLVED that the City recognizes the benefits of vacating the Edison Road right-of-way.
BE IT FURTHER RESOLVED that the Common Council hereby authorizes the payment of $8,000 to Mid-America Steel Drum, Inc., in lieu of repaving Edison Road, as a condition of the forthcoming vacation of the Edison Road right-of-way. Payment is not to be made until the vacation of the right-of-way is completed.
