Recommendation:  That the Common Council adopt Resolution No. 10545-090605, a resolution releasing the Developer, Amoco Oil Company, from the terms and conditions of their 1983 Site Development Agreement at 1225 W. Rawson Avenue (Tax Key No. 764-9041) (1st Aldermanic District).

 

BACKGROUND:  The Developer has performed all obligations required under the development agreement, to the satisfaction of the Engineering Department. There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

1225 W. RAWSON AVENUE

(3rd ALDERMANIC DISTRICT)

 

            WHEREAS, Amoco Oil Company, hereinafter referred to as the “Developer”, has performed all obligations required by their 1983 Site Development Agreement, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved agreement, and

 

            WHEREAS, the Developer has met all the conditions and obligations of the approved 1983 Site Development Agreement for 1225 W. Rawson Avenue, Tax Key No. 764-9041, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the 1225 W. Rawson Avenue (Tax Key No. 764-9041) Site Development Agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 6th day of September, 2005.
