Recommendation: That the Council adopt Ordinance No. 2368, which would rezone the property 6865 S. 13th Street from Rs-4, Single Family Residential to Rm-1, Multi-Family Residential and authorize the issuance of a conditional use permit for multiple-family dwellings in excess of four (4) dwelling units per structure to the properties at 6865, 6871, 6883, & 6955 S. 13th Street.
Background: Mark Wimmer is requesting that the property at 6955 S. 13th Street be rezoned from Rs-4, Single Family Residential to Rm-1, Multi-Family Residential with a conditional use for multiple-family dwellings in excess of four (4) dwelling units per structure. In addition the applicant is requesting that a conditional use be granted for the properties at 6871, 6883 & 6955 S. 13th Street to allow for multiple-family dwellings in excess of four (4) dwelling units per structure.
This request is to allow for the expansion of the Southfield apartment complex (formerly known as Green Hills Village). The existing apartment community is 10.7 acres. The proposed expansion would add an additional 7.5 acres and would have 64 additional units in eight (8) eight-family unit buildings. The Rm-1 zoning ordinance allows more than four (4) dwelling units in a single building as a conditional use. This request is consistent with the adopted Comprehensive Plan and future land use map.
The applicant has also worked with the property owner to the east and has made some site revisions to minimize the impact on his property. This includes installing a fence along the eastern property line of the Southfield expansion area. The details of this development will be brought back to the Plan Commission for review and approval when they come forward for site, landscaping, and building plan review.

Fiscal Impact: Data has suggested that the development of 2-bedroom apartment units has a slight positive fiscal impact on the City. The 64-unit expansion of this development will result in the payment of $100,736 in impact and development fees.
