RECOMMENDATION: That the Common Council adopt Resolution No. 10536-081605, a resolution approving an amendment to the Oakwood Crossings Business Center-Phase I Development Agreement, providing for the extension of public sanitary sewer (Project No. 03053) (5th Aldermanic District).
BACKGROUND: At the time of approval and signature for the Oakwood Crossings Business Center – Phase I development agreement, the proposed north/south Milwaukee Metropolitan Sewerage District Interceptor planned for the west side of the Chicago, Minneapolis, St. Paul and Pacific Railroad right-of-way, from W. Oakwood Road to W. Ryan Road, was not available.
The Interceptor is now available and the Developer, Opus North, wishes to construct the main public sanitary sewer outlet for the Oakwood Crossings Business Center at this time, under his current Phase I agreement. The Oak Creek Water and Sewer Utility and the Engineering Department are in agreement with the extension at this time.

CENTENNIAL PARK WEST COMMERCE CENTER
(PROJECT NOS. 99066, 99067)
(3rd ALDERMANIC DISTRICT)
WHEREAS, Centennial Park Commerce Center, LLC, hereinafter referred to as the “Developer”, has constructed the public improvements required by the Centennial Park West Commerce Center, and
WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and
WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, storm sewer, sidewalk, street, light and tree plans for Centennial Park West Commerce Center, and
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Centennial Park West Commerce Center development agreement.
