AN ORDINANCE TO AMEND SECTIONS 17.1305, 17.1306, 17.1307, 17.1308, and 17.1310
OF THE MUNICIPAL CODE REGARDING THE SIDE YARD SETBACKS FOR RESIDENTIAL BUILDINGS WITH SIDE ENTRY GARAGES
The Common Council of the City of Oak Creek does hereby ordain as follows:
SECTION 1: Section 17.1305 (f)(2) of the Municipal Code is hereby repealed and recreated to read as follows:
There shall be a side setback on each side of all principal residential buildings of not less than ten (10) feet in width; Additionally, for structures with a side-entry garage, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.
SECTION 2: Section 17.1306 (f)(2) of the Municipal Code is hereby repealed and recreated to read as follows:
There shall be a side setback on each side of all principal residential buildings of not less than ten (10) feet in width; Additionally, where a side-entry garage exists, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.
SECTION 3: Section 17.1307 (f)(2) of the Municipal Code is hereby repealed and recreated to read as follows:
There shall be a side setback on each side of all principal residential buildings of not less than ten (10) feet in width; Additionally, where a side-entry garage exists, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.
SECTION 4: Section 17.1308 (f)(2) of the Municipal Code is hereby repealed and recreated to read as follows:
There shall be two (2) side setbacks for all principal residential buildings totaling not less than sixteen (16) feet, with one being not less than six (6) feet; Additionally, where a side-entry garage exists, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.
SECTION 5: Section 17.1310 (f)(2) of the Municipal Code is hereby repealed and recreated to read as follows:
There shall be a side setback on each side of all principal residential buildings of not less than ten (10) feet in width; Additionally, where a side-entry garage exists, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.
SECTION 6: All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
SECTION 7: This ordinance shall take effect and be in force from and after its passage and publication.
