Recommendation: That the Common Council
a. adopt Resolution No. 10532-071905, a resolution creating a Dust and Noise Abatement Grant program related to the WE Energies Power Plant Project, and,
b. designate the availability of the program initially to Area A of the plan.
Background: The construction of the new WE Energies Elm Road Generating Station power plant is under way. Major grading will commence within a couple of weeks. Part of the City’s justification for seeking mitigation payments included assistance to the most impacted homeowners. The Supreme Court decision allowing the construction of the power plant upheld mitigation payments, although details of the timing and amounts to be received are still not available.
The attached document, created with the assistance of Hurtado Consulting, LLC, lays out a program to provide grants to 100 homes within a limited geographical area, (see Area A on map in attached document), in order to improve noise and dust control within their structures. If fully utilized by all 100 homeowners in Area A, the cost will be approximately $430,000, of which $400,000 will be actual grants and $30,000 will cover permits and inspections.
Key elements of the program are:
· Maximum reimbursement grant per homeowner is $4,000
· Eligible costs are for furnaces, air conditioners, air filters, ventilation, energy recovery systems, caulk, weather-stripping, windows, doors, sound attenuating curtains and drapes, or insulation.
There are some additional options that the Council could consider as part of this action:
· the Council could expand the immediate availability to Area B, or to Areas B & C, rather than waiting to evaluate the program after it is underway;
· the maximum grant amount of $4,000 could be lowered to allow the funds to be initially allocated over a larger area;
· any unused funds from the amount allocated to Area A could be made available to Area B or Areas B & C on a first-come, first-served basis, or based on proximity to Area A.
Fiscal Impact: Funds in the amount of $430,000 would be advanced from the Capital Improvement Fund until sufficient mitigation funds are received.

RESOLUTION ESTABLISHING
A DUST AND NOISE ABATEMENT GRANT PROGRAM
(4ST ALDERMANIC DISTRICT)
WHEREAS, the City of Oak Creek desires to implement a program to assist the homeowners most affected by the WE Energies Elm Road Generating Station power plant construction; and
WHEREAS, the City of Oak Creek will be receiving mitigation money from WE Energies; and,
WHEREAS, a Dust and Noise Abatement Grant program has been developed by staff with the assistance of Hurtado Consulting LLC
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached Dust and Noise Abatement Grant program description is hereby accepted by the City.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to implement said program upon the official date of commencement of construction of the WE Energies power plant.
