Recommendation: That the Common Council adopt Resolution No. 10519-060705, a resolution approving and accepting a public drainage easement from the City of Oak Creek across the rear of the properties at 2230 and 2300 W. Southland Drive, Oak Creek, WI, 53154 (Tax Key Nos. 856-0047 and 856-0048) (6^th Aldermanic District).

Background: The proposed public drainage easement dedication is necessary prior to the sale of the properties. The City currently has drainage easements on Southland Creek between S. 21^st Street to S. 26^th Street except for these properties which the City owns. The proposed drainage easement will protect previously installed drainage improvements on the drainageway.

Fiscal Impact: None. The easement is being dedicated from the City to the City.

RESOLUTION APPROVING A PUBLIC DRAINAGE EASEMENT

AT 2230 AND 2300 W. SOUTHLAND DRIVE

(TAX KEY NOS. 856-0047 AND 856-0048)

(6^th ALDERMANIC DISTRICT)

WHEREAS, the City of Oak Creek are said Owners of the properties at 2230 and 2300 W. Southland Drive, Oak Creek, WI, 53154 (Tax Key Nos. 856-0047 and 856-0048) and,

WHEREAS, the City requires that the Owner of said properties at 2230 and 2300 W. Southland Drive dedicate a drainage easement to protect previously installed drainage improvements and,

WHEREAS, the required public drainage easement has been prepared by the City,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public drainage easement, is hereby dedicated, approved and accepted0 by the City.

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached public drainage easement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
