Recommendation:  That the Council adopt Ordinance No. 2353, approving the rezoning of portions of the property at 9160 South Pennsylvania Avenue from M-1, Manufacturing to B-3, Office and Professional Business.

 

Background: Cary and Lori Schmidt are requesting that a 2.2 acre portion of the property at 9160 S. Pennsylvania Avenue be rezoned from M-1, Manufacturing to B-3, Office and Professional Business to allow for the construction of a dance studio.  Dance studios are listed as a permitted use in the B-3 zoning district.  This property has a significant amount of floodplain on it leaving only the front 240 feet of the property developable.  Additionally the impact on the area if this parcel is developed as M-1 or B-3 is relatively the same. Given the limited space and neighborhood impact, staff has no objections to rezoning this parcel to B-3.

 

There is a rough sketch of the site layout for the dance studio included with this staff report. Keep in mind that the applicant will need to return to the Plan Commission with detailed site, architectural, and landscaping plans. Sanitary sewer and municipal water will need to be extended to this property.  The applicant has been made aware of this. These and other issues will be addressed when the applicant submits the site, building, and landscaping plans for review.

 

The Plan Commission has reviewed this request, and has recommended that the rezoning be approved.

 

Fiscal Impact:  Both the existing M-1 and the proposed B-3 zoning district allow for development that will add to the City’s nonresidential tax base.
