Recommendation:  That the Council adopt Ordinance No. 2352, approving the rezoning of portions of the property at 2555 West Ryan Road from B-3, Office and Professional Business CU to B-4, Highway Business.

 

Background: Tri City National Bank is requesting that part of their property at 2555 W. Ryan Road be rezoned from B-3, Office and Professional Business with a Conditional Use for a group day care facility with an outdoor activity area to B-4, Highway Business.  In 1999 this property was rezoned from B-4, Highway Business to B-3, Office & Professional Business to allow for the construction of LaPetite Child Care Center with a conditional use for the outdoor activity area.  This business was never constructed nor was the parcel split off via certified survey map.  Tri City is now requesting that this land be rezoned back to its original B-4 zoning to match the zoning on the rest of their parcel.  Additionally, all of the surrounding parcels are zoned B-4, Highway Business, and the Comprehensive Plan identifies this property as Planned Business.

 

The Plan Commission has reviewed this request, and has recommended that the rezoning be approved.

 

Fiscal Impact:  The B-4, Highway Business zoning district allows greater flexibility in the type of uses permitted.  It is more likely that the property would develop under the B-4 zoning, bringing with it additional nonresidential tax base.
