Recommendation:  That the Council adopt Ordinance No. 2349, which would amend the official map for the Southwest ¼ of Section 6.

 

Background:  Gary Kraeger is requesting that the official map be amended to remove an officially mapped section of S. 21st Street which runs from W. Wood Avenue south approximately 1,167 feet to another officially mapped east-west street.  He is requesting this map amendment because he prefers not to dedicate and improve a segment of road running along the west end of his property if the rest of the road is likely to never be installed.  The applicant has applied for approval of a certified survey map (CSM) and the City typically requires road dedication and improvement when a CSM is submitted that contains an officially mapped street.  The CSM application is on hold until the Common Council makes a decision regarding the official map.  There is a copy of the CSM as it would be divided with the roadway dedication included with this report.

 

When considering a proposal to amend an official map the Commission should consider the impact upon the ability to logically develop adjacent properties in accordance with the existing official map.  Nearby property owners may have an interest in maintaining certain aspects of an official map if it provides them the future opportunity to subdivide their property in a cost effective manner.  If a person is proposing to remove this opportunity, or to alter it, they need to demonstrate that any adverse affects on the property owners involved would be offset by the benefit to the neighborhood.  In other words, a property owner should not be able to amend the official map to maximize the development potential of his or her property at the detriment of surrounding properties.  Staff supports removing this section of the official map as long as the other property owners along this section are not opposed to its removal.

 

The Plan Commission has reviewed this request and has recommended that the official map be amended as requested.

 

Fiscal Impact:  The realignment of this street pattern on the official map does not have any direct fiscal impact on the City.
