Recommendation:  That the Common Council adopt Resolution No. 10514-051705, a resolution approving a public sanitary sewer easement from MEYER REVOCABLE TRUST, for the proposed public sanitary sewer at 2320 W. Ryan Road, Oak Creek, WI, 53154 (Tax key No. 878-9994-002) (6^th Aldermanic District).

Background:  The proposed public sanitary sewer easement, and the associated sanitary sewer, provides public sanitary sewer service to the new Pick-n-Save store, now under construction.  The proposed sanitary sewer will also serve abutting properties along W. Ryan Road to S. 27^th Street.         

Fiscal Impact: None.  Project is developer-funded.

RESOLUTION APPROVING A PUBLIC SANITARY SEWER EASEMENT

AT 2320 W. RYAN ROAD

(TAX KEY NO. 878-9994-002)

(6^th ALDERMANIC DISTRICT)

                                                                                                            WHEREAS, The MEYER REVOCABLE TRUST is said owner of lands at 9472 S. 27^th Street, Oak Creek, WI, 53154 and,

                                                                                                            WHEREAS, the City of Oak Creek Water and Sewer Utility requires that the Owner of said lands enter into a public sanitary sewer easement agreement for the extension of public sanitary sewer to service the new Pick-n-Save store at 2320 W. Ryan Road, and

                                                                                                            WHEREAS, the required public sanitary sewer easement agreement has been prepared and signed by the Owner,

                                                                                                            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public sanitary sewer easement agreement, as signed by the Owner, is hereby approved by the City.

                                                                                                            BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached agreement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
