Recommendation:  That the Council consider Resolution No. 10516-051705, approving a memorandum of understanding regarding access for the John G. Gonis Real Estate Limited Partnership.

 

Background:  The John G. Gonis Real Estate Limited Partnership (Gonis Partnership) owns the properties at 7028 and 7050 South 27th Street and 2414, 2436, 2508, 2528 and 2602 West Rawson Avenue (Gonis Property).  The Gonis Partnership is in the process of developing the Gonis Property for office and retail purposes.  In order to do so, they are working with the Wisconsin Department of Transportation (WisDOT) to secure access to South 27 th Street.  WisDOT, in their review of the plans for the Gonis Property, has determined that a permanent access point to 27th Street from the property would conflict with the operation of the State highway and its intersection with W. Rawson Avenue.

 

The Gonis Partnership has been working with the WisDOT and the City of Oak Creek to come to a consensus on the near-term and permanent access needs for this, and adjacent properties along S. 27th Street.

 

The attached memorandum of understanding (M.O.U.) would permit the construction of a temporary driveway access at the north end of the Gonis Property.  This driveway access would be shared by the adjacent property to the north.  The longer term plan is to direct the traffic from the Gonis development, and that of the adjacent properties to the north, to the signalized intersection at Riverwood Drive.  At such time as the properties to the north develop, they would be required to provide cross access easements in order to make that future connection.  Once those connections are made, the driveway at the north end of the Gonis property would be removed.

 

The City is party to this M.O.U. in order to provide a basis for the review of access for these properties when they develop.  It does not obligate the City to construct such access.

 

Fiscal Impact:  The approval of this memorandum of understanding will allow for the potential of additional development on this, and adjacent parcels, which will have a positive fiscal impact.
