Recommendation:  That the Common Council adopt Resolution No. 10503-040405, a resolution declaring intent to exercise special assessment powers for Project No. 04003, reconstruction of the roadways in Southbranch Industrial Park, and to establish a public hearing date for May 3, 2005 (6th Aldermanic District).

 

Background The project is needed to repair the failing asphalt pavement in the Industrial Park. 

 

Each affected property owner has been sent a letter introducing the project and invited to attend a public information meeting explaining the special assessment process. 

 

Fiscal Impact:  The City of Oak Creek will initially fund the entire cost of the project, and shall be reimbursed as special assessments are received.  The estimated cost of the project is $1,400,000.

PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE

SPECIAL ASSESSMENT POWERS UNDER SECTION 3.20

OF THE MUNICIPAL CODE OF THE CITY OF OAK CREEK

(RECONSTRUCTION OF ROADWAYS IN SOUTHBRANCH INDUSTRIAL PARK)

 

(PROJECT NO. 04003)

 

(6TH ALDERMANIC DISTRICT)

 

RESOLVED, by the Common Council of the City of Oak Creek, Wisconsin:

 

1.         The Common Council hereby declares its intentions to exercise its power under Section 3.20 of the Municipal Code of the City of Oak Creek, to levy special assessments upon property within the following described district for benefits conferred upon such property by the following improvements in the following location:

 

PROJECT NO. 04003 SOUTHBRANCH INDUSTRIAL PARK

 

All property fronting on or using a primary access:

 

W. Southbranch Blvd.

S. 20th St.

W. Ridgeview Dr.

S. Ridgeview Dr.

From:  S. 27th St.

2.         Said public improvements shall include the pulverization of the existing asphalt surface, installation of a 31” vertical face concrete curb and gutter, and the placement of a new asphalt pavement.  The project will also include minor storm sewer improvements and street lighting.

 

3.         W. Southbranch Boulevard will also include the installation of a median with concrete curb and gutter.

 

4.         The total amount assessed against such district shall not exceed the portion of the total cost of the improvements to be paid by the City of Oak Creek.  The Common Council determines that such improvements shall be made under the police power.  Each of the abutting property owners shall be assessed for the improvements in the manner set forth in Section 3.20 of the Municipal Code of the City of Oak Creek.

 

5.         The Common Council further declares that the assessments may be paid in cash, in five/ten annual installments in accordance with Section 3.210 of the Municipal Code of the City of Oak Creek; if paid in installments, the same shall bear interest at the rate of 7% annum on the unpaid balance.

 

6.         The Engineering Department is directed to prepare a report consisting of:

 

A.         Preliminary plans and specifications for said improvements.

 

B.         An estimate of the entire cost of the proposed improvements. 

 

C.        A schedule of the proposed assessments to be levied against such parcel of property within the assessment district.

 

D.        Upon completing such report, the Engineering Department is directed to file a copy thereof in the City Clerk’s office for public inspection.

 

7.         Upon receiving the notice of the Engineering Department, the Clerk is directed to give notice of a public hearing on such report as specified in Section 3.203 of the Municipal Code of the City of Oak Creek.

 

The hearing shall be held at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 3.203 of said code.
