Recommendation:  That the Common Council adopt Resolution No. 10501-040405 a resolution declaring intent to exercise special assessment powers for Project No. 05105, sanitary sewer in Drexel Avenue from approximately 200 feet west of Long Meadow Drive to approximately 1,600 feet west of Long Meadow Drive, and to establish a public hearing date for May 3, 2005 (1st and 3rd Aldermanic Districts).

 

Background: Property owners initiated the project through a petition for public sanitary sewer service initiated the project.  Four of the seven affected property owners signed the petition.  This project would provide sanitary sewer service to 6 properties on the south side of Drexel Avenue and to the Korean Church being built on the north side of Drexel Avenue.  If approved, the installation should be completed by the fall of this year (see attached map).

 

Each affected property owner was sent a letter introducing the project and briefly explaining the special assessment process. 

 

The Oak Creek Water and Sewer Utility Commission approved the project at their March 16, 2005 meeting.

 

Fiscal Impact:  The Oak Creek Water and Sewer Utility will initially fund the entire cost of the project, and shall be reimbursed as special assessments are received.  The estimated cost of the project is $108,000.

PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE

SPECIAL ASSESSMENT POWERS UNDER SECTION 3.20

OF THE MUNICIPAL CODE OF THE CITY OF OAK CREEK

(SANITARY SEWER IN DREXEL AVENUE)

 

(PROJECT NO. 05105)

 

(1ST AND 3RD ALDERMANIC DISTRICTS)

 

RESOLVED, by the Common Council of the City of Oak Creek, Wisconsin:

 

1.         The Common Council hereby declares its intentions to exercise its power under Section 3.20 of the Municipal Code of the City of Oak Creek, to levy special assessments upon property within the following described district for benefits conferred upon such property by the following improvements in the following location:

 

PROJECT NO. 05105 SANITARY SEWER AND LATERALS

 

All property fronting on:

 

Both sides of S. DREXEL AVENUE

 

From: 200’± west of Long Meadow Drive

To:       1,600’± west of Long Meadow Drive

 

2.         Said public improvements shall include the installation of gravity sanitary sewer, grinder pump force main, and laterals.

 

3.         The total amount assessed against such district shall not exceed the portion of the total cost of the improvements to be paid by the City of Oak Creek.  The Common Council determines that such improvements shall be made under the police power.  Each of the abutting property owners shall be assessed for the improvements in the manner set forth in Section 3.20 of the Municipal Code of the City of Oak Creek and the assessment rates as set forth in Common Council Resolution No. 10184-120302.

 

4.         The Common Council further declares that the assessments may be paid in cash, in five/ten annual installments in accordance with Section 3.210 of the Municipal Code of the City of Oak Creek; if paid in installments, the same shall bear interest at the rate of 7% annum on the unpaid balance.

 

For those properties which are vacant or have one residential dwelling unit, that are two and one half (2 ˝) acres or more in area, or have three hundred thirty (330) feet or more of assessed frontage, payment shall be made within twenty (20) years of the date of levy in equal annual installments on the property tax bill with interest at the rate of 7% per annum on the unpaid balance.

 

5.         The Utility Engineer is directed to prepare a report consisting of:

 

A.         Preliminary plans and specifications for said improvements.

 

B.         An estimate of the entire cost of the proposed improvements. 

 

C.        A schedule of the proposed assessments to be levied against such parcel of property within the assessment district.

 

D.        Upon completing such report, the Utility Engineer is directed to file a copy thereof in the City Clerk’s office for public inspection.

 

6.         Upon receiving the notice of the Utility Engineer, the Clerk is directed to give notice of a public hearing on such report as specified in Section 3.203 of the Municipal Code of the City of Oak Creek.

 

The hearing shall be held at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 3.203 of said code.
