Recommendation:  That the Council hold Ordinance No. 2346, creating Sections 17.029, 17.0330, 17.0331 and  17.0333 of the Municipal Code regarding South 27th Street overlay zoning districts and design standards until the May3, 2005 Common Council meeting.

 

Background:  On February 1, 2005 the Council adopted Resolution No. 10458 adopting the South 27th Street Corridor Plan.  That plan recommended several land use districts and design standards for the six mile corridor.

 

Also on February 1, 2005 the Council authorized a contract with Ruekert & Mielke to draft the language of those new overlay districts and design standards.  This contract was later amended to include the drafting of language for the urban village zoning, which will be considered at a later public hearing.

 

Planning staff has reviewed the draft ordinance, and has some concern regarding how these overlay districts are to be implemented.  Also, the City Attorney has not had an opportunity to provide comments on the proposed ordinance.

 

The Plan Commission has reviewed the draft ordinance, and has recommended its approval, with minor changes to better address how home occupations are treated in the residential areas of the overlay districts.

 

Given these issues, it would be appropriate to hold the public hearing on the proposed changes, but to withhold action on this ordinance change until those issues can be addressed.

 

Fiscal Impact:  Proper planning for the 27th Street corridor will create long-term, sustainable tax base for the City.
