Recommendation: That the Common Council adopt Resolution No. 10510-041905, a resolution approving and accepting a public water main easement from Herman C. and Elizabeth J. Kopplin for a proposed public water main across the frontage of their property at 6955 S. Howell Avenue, Oak Creek, WI, 53154 (Tax Key No. 734-9991-002) (1^st Aldermanic District).

Background: The proposed public water main easement is necessary as part of the installation of public water main required under the MRT Investments, LLC CSM at 150 W. Rawson Avenue (Milo Thomas Car Wash). The proposed public water main installation also fulfills Oak Creek Water and Sewer Utility looping requirements.

Fiscal Impact: None. The easement is being dedicated at no cost to the City.

RESOLUTION APPROVING A PUBLIC WATER MAIN EASEMENT

AT 6955 S. HOWELL AVENUE

(TAX KEY NO. 734-9991-002)

(1^st ALDERMANIC DISTRICT)

WHEREAS, Herman C. and Elizabeth J. Kopplin are said Owners of the property at 6955 S. Howell Avenue, Oak Creek, WI, 53154 (Tax Key No. 734-9991-002) and,

WHEREAS, the City requires that the Owners of said property at 6955 S. Howell Avenue dedicate a water main easement for the installation of public water main to service the MRT Investments, LLC CSM (Milo Thomas Car Wash) at 150 W. Rawson Avenue and,

WHEREAS, the required public water main easement has been prepared and signed by the Owners,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public water main easement, as signed by the Owners, is hereby approved by the City.

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached public water main easement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
