Recommendation:  That the Common Council adopt Ordinance 2343 to repeal and recreate Section 15.201 of the Municipal Code regarding adoption by reference of State and National Codes.

 

Background: The State Building Code requirements are based on use and occupancy.  The structures or portions of structures shall be classified with respect of occupancy in one or more of ten major groups. Where a structure is proposed for a purpose which is not specifically provided for in the code such structure shall be classified in the group which the occupancy most nearly resembles, according to the fire safety and relative hazard involved.  The building code does not adequately address the unique fire safety requirements of piers, marinas, and electric power generating plants.  The National Fire Protection Association (NFPA) is an independent, voluntary, nonprofit organization whose mission is to reduce the worldwide burden of fire and other hazards on the quality of life by providing scientifically-based consensus codes and standards.  The adoption of NFPA 303, 307 and 850 would provide a minimum acceptable level of safety to life and property from fire and explosions.
