RecommendationThat the Common Council adopt Ordinance No. 2340 to repeal and recreate section 6.60 (g) (3) (b) relating to residential driveways.

 

BackgroundThe City has been asked to review the requirements for driveways on corner lots.

 

The existing requirement (on a corner lot) for the distance between a driveway and a street corner is 50 feet.  This requirement is 20 feet more than the house setback requirement of 30 feet and has become more onerous as garage standards have moved from detached, to one, two and three-car attached garages.

 

From a safety perspective, having driveways placed away from intersections is good.  It is felt that the Council could reduce the requirement to 40 feet without negatively impacting safety.

 

The CIP Committee has reviewed this request and recommends that the requirement be reduced to 40 feet.

ORDINANCE NO. 2340

AN ORDINANCE TO REPEAL AND RECREATE SECTION 6.60 (g) (3) (b)

RELATING TO RESIDENTIAL DRIVEWAYS

 

The Common Council of the City of Oak Creek does hereby ordain as follows:

 

SECTION 1:    SECTION 6.60 (g) (3) (b) of the Municipal Code is hereby repealed and recreated to read as follows:

 

(b)        On corner lots, no part of the driveway shall be closer than forty (40) feet to the intersection of the property lines extended on the public right-of-way sides of the corner lot.

 

SECTION 2:    All ordinances or parts of ordinances containing the provisions of this ordinance are hereby repealed.

 

SECTION 3:    This ordinance shall take effect and be in force from and after its passage and publication.

 

            Introduced this 15th day of March, 2005.
