Recommendation:  That the Council consider Resolution No. 10487-030105, approving a certified survey map for the property at 150 West Rawson Avenue

 

Background:  The applicant is requesting approval of a certified survey map dividing the property at 150 W. Rawson into two (2) lots.  Lots in the B-4 Highway Business require a minimum lot area of 30,000 square feet and 150 feet of lot width.  Both of the lots being created by this CSM exceed this requirement. 

 

Parcel 1 is the location of the existing Citgo Gasoline Station.  Parcel 2 will be used for the future development of a 2-bay automatic car wash.  All access to Parcel 2 will be from driveways on Parcel 1.  The CSM provides for cross-access between the two parcels.

 

The existing development agreement for the Citgo station development stipulates that if any further development or property division occurs on this parcel, a watermain loop must be installed form its existing terminus on W. Rawson Avenue to the existing terminus on S. Howell Avenue.  Staff met with the City Attorney to discuss the issues surrounding the development agreement.  It is the City Attorney’s opinion that the application for the Certified Survey Map (CSM) can be recommended for Common Council action by the Plan Commission as long as there is a condition that the CSM cannot be recorded with Milwaukee County until all of the required public improvements are completed.  The applicant is entering into a development agreement with the City to specify the responsibility for and the timing of any public improvements, including installation of the required watermain loop as part of the CSM application.

 

The Plan Commission has reviewed this request, and recommended its approval.

 

Fiscal Impact:  The development of this property will have a positive fiscal impact on the City.  There are no outstanding assessments affecting this property.
