Recommendation: That the Council adopt Resolution No. 10488-030105, which would approve the development agreement for the car wash development at 150 W. Rawson Avenue.
Background: On December 12th of last year the Plan Commission conditionally approved the site and building plans for a car wash at 150 W. Rawson Avenue (see attached minutes). One of the conditions of that approval was that the water main loop is installed as required prior to the issuance of building permits.
This development agreement establishes the timing of, and the responsibility for those water main improvements. It also addresses such issues as the provision of sidewalks along Howell Avenue, although the developer of the property is questioning this requirement (see attached letter).
The development agreement is with the developer of this property, not the actual owner, as is typical. The developer can not take ownership of the property until a certified survey map is recorded. However the CSM can not be recorded until the public improvements are completed. The developer is providing a letter of credit to cover the cost of these improvements.
Fiscal Impact: The taxes generated by the development of this car wash will have a positive fiscal impact on the City. There are no outstanding assessments on this property.
