Recommendation: That the Common Council adopt Resolution No. 10485-030105, a resolution approving public water main easements from Henry T. and Caroline E. Czarneck, at 200 W. Rawson Avenue, and from Mohareb A. and Sina M. Hamden, of 150 West Rawson, LLC for the proposed public water main easements at 150 and 200 W. Rawson Avenue, Oak Creek, WI, 53154 (Tax key Nos. 734-9022, 9023) (1st Aldermanic District).

Background: The proposed public water main easements, and the associated water main, provides water main service to the new proposed car wash at S. Howell Ave. and W. Rawson Ave.. The water main as proposed, will be extended to the north to connect into existing water main, fulfilling water main looping requirements of the Oak Creek Water and Sewer Utility. The water main is a requirement of the MRT Investments-developer of the proposed car wash- development agreement.

Fiscal Impact: None. Project is Developer funded.

RESOLUTION APPROVING PUBLIC WATER MAIN EASEMENTS AT 150 AND 200 W RAWSON AVENUE (TAX KEY NOS. 734-9022, 9023)

(1ST ALDERMANIC DISTRICT)

WHEREAS, Henry T. and Caroline E. Czarnecki and Mohareb A. and Sina M. Hamden are said owners of lands at 150 and 200 W. Rawson Avenue, Oak Creek, WI, 53154 and,

WHEREAS, the City of Oak Creek Water and Sewer Utility requires that the Owner of said lands enter into a Public Water Main Easement agreement for the extension of public water main to service the proposed MRT Investments car wash at S. Howell Ave. and W. Rawson Ave.and to fulfill water main looping requirements, and

WHEREAS, the required Public Water Main Easement agreements have been prepared and signed by the Owner,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached Public Water Main Easement agreements, as signed by the Owners, is hereby approved by the City.

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached agreement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
