Recommendation:  That the Common Council consider the following for the Ashbury Woods Condominiums development at 8435 S. Chicago Road (Project Nos. 03063, 03064) (Tax Key Nos. 823-9019) (4^th Aldermanic District):

1.         Resolution No. 10482-030105, a resolution approving release of public utility easements for the Ashbury Woods property at 8435 S. Chicago Road.

2.         Resolution No. 10483-030105, a resolution accepting public utility easements for the Ashbury Woods property at 8435 S. Chicago Road.

Background:  The location of required public utilities for the Ashbury Woods Condominiums development, located at 8435 S. Chicago Road, and owned by Heritage Development has been determined.  It is now possible to complete the partially released easements, which were part of the Atlas Affordable Housing and City of Oak Creek agreement to resolve differences and allow development of the site.

The attached resolutions, descriptions and exhibits contain the necessary existing public utility easement releases and the corresponding necessary new public utility easements.

FISCAL IMPACT: None.
