Recommendation:  That the Common Council adopt Resolution No. 10479-030105, a resolution releasing the Developer, Centennial Park, LLC, from the terms and conditions of their Centennial Park East Apartments development agreement, City Project Nos. 99064, 99065 (Tax Key Nos. 860-9022 to 9024, 9026 to 9029) (3rd Aldermanic District).

 

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required public improvements for Centennial Park East Apartments.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

CENTENNIAL PARK EAST APARTMENTS

 

(PROJECT NOS. 99064, 99065)

 

(3rd ALDERMANIC DISTRICT)

 

            WHEREAS, Centennial Park, LLC, hereinafter referred to as the “Developer”, has constructed the public improvements required by the Centennial Park East Apartments, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and

 

            WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, storm sewer, sidewalk, street, light and tree plans for Centennial Park East Apartments, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Centennial Park East Apartments development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 1st day of March, 2005.

 

            Passed and adopted this 1st day of March, 2005.
