Recommendation: That the Common Council adopt Resolution No. 10475-030105, a resolution accepting a quit claim deed for additional public right-of-way along the frontage of 1800 E. Drexel Avenue (1st Aldermanic District).
Background: 1800 E. Drexel Avenue is a City-owned parcel. Currently, the north half of the public right-of-way along this parcel’s frontage is 33’. The quit claim deed widens this dimension to 45’, thereby matching the right-of-way width of the abutting properties to both the east and west. This is one of the few parcels from which the City did not acquire additional right-of-way at the time Drexel Avenue was widened in 1996, probably due to the fact that it is a City-owned parcel.
For a number of reasons, now is the appropriate time for the acquisition of additional right-of-way. WE Energies has recently approached the City requesting an easement across the property frontage to install underground electric cables to provide service for the development at 2020 E. Drexel Avenue. The additional right-of-way would eliminate the need for an easement, as their proposed facilities would then be installed in the public right-of-way. In addition, the acquisition would place the existing sidewalk within the public right-of-way. The sidewalk is currently situated across the frontage of the parcel itself. Finally, if ownership of the property was to change in the future, the City will have already secured the desired 45’ north half right-of-way width.

RESOLUTION ACCEPTING QUIT CLAIM DEED
FOR ADDITIONAL PUBLIC RIGHT-OF-WAY
AT 1800 E. DREXEL AVENUE
(1ST ALDERMANIC DISTRICT)
WHEREAS, the City of Oak Creek desires additional public right-of-way along the frontage of 1800 E. Drexel Avenue, a City-owned parcel.
WHEREAS, the acquisition via quit claim deed would increase the north half right-of-way width from 33’ to 45’ along the frontage of 1800 E. Drexel Avenue.
WHEREAS, the quit claim deed has been prepared affecting the following property owner, to wit:
City of Oak Creek
1800 E. Drexel Avenue
Tax Key No. 779-9989
and said quit claim deed is attached hereto.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached quit claim deed is hereby accepted by the City.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached quit claim deed on behalf of the Common Council of the City of Oak Creek and upon said execution the City Attorney is authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
