Recommendation:  That the Common Council adopt Resolution No. 10464-021405, a resolution releasing the Developer, Kaerek Builders, Inc., from the terms and conditions of their Ryan Oaks Subdivision development agreement, City Project Nos. 99060, 99061 (Tax Key Nos. 907-0161 to 0190, 0196, 0197, 0198) (5th Aldermanic District).

 

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required public improvements for Ryan Oaks Subdivision.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

RYAN OAKS SUBDIVISION

 

(PROJECT NOS. 99060, 99061)

 

(5TH ALDERMANIC DISTRICT)

 

            WHEREAS, Kaerek Builders, Inc., hereinafter referred to as the “Developer”, has constructed the public improvements required by the Ryan Oaks Subdivision, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and

 

            WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, storm sewer, sidewalks, streets, street lights and trees for Ryan Oaks Subdivision, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Ryan Oaks Subdivision development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 14th day of February, 2005.

 

            Passed and adopted this 14th day of Febeuary, 2005.
