Recommendation:  That the Common Council adopt Resolution No. 10461-021405, a resolution releasing the Developer, Suburban Development, Inc., from the terms and conditions of their Oakshire, Oakshire Addition No. 1 and Oakshire Addition No 2 Subdivision’s development agreement, City Project Nos. 92080, 92180, 96055, 96056, 97052 and 97053 (Tax Key Nos. 861-0037 to 0074 and 861-0085 to 0126) (3rd Aldermanic District).

 

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required public improvements for Oakshire, Oakshire No. 1 and Oakshire No 2 Subdivisions.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

OAKSHIRE, OAKSHIRE ADDITION NO. 1

& OAKSHIRE ADDITION NO. 2 SUBDIVISIONS

 

(PROJECT NOS. 92080, 92180, 96055, 96056, 97052 & 97053)

 

(3RD ALDERMANIC DISTRICT)

 

            WHEREAS, Suburban Development, Inc., hereinafter referred to as the “Developer”, has constructed the public improvements required by the Oakshire, Oakshire Addition No. 1 and Oakshire Addition No. 2 Subdivisions, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and

 

            WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, streets and drainage facilities plans for Oakshire, Oakshire Addition No.1 and Oakshire Addition No. 2 Subdivisions, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Oakshire, Oakshire Addition No. 1 and Oakshire Addition No. 2 Subdivisions’ development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 14th day of February, 2005.

 

            Passed and adopted this 14th day of February, 2005.
