RecommendationThat the Common Council adopt Resolution No. 10465-021405, a resolution releasing the Developer, Richard J. Schumacher and Joan Walter-Mickelsen, from the terms and conditions of their Nature Haven Subdivision development agreement, City Project Nos. 99071, 99072 (Tax Key No. 826-9023) (3rd Aldermanic District).

 

BACKGROUND:  The Developer of Nature Haven Subdivision never did commence with the subdivision development and subsequently sold it to Benjamin M. Real Estate, LLC.  Benjamin M. Real Estate, LLC, in turn, developed the property as Patriot Arms Subdivision, under a new development agreement. The files and project numbers for Nature Haven have been closed and there are no outstanding fees owed by the Developer.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

NATURE HAVEN SUBDIVISION

 

(PROJECT NOS. 99071, 99072)

 

(3rd  ALDERMANIC DISTRICT)

 

            WHEREAS, Richard J. Schumacher and Joan Walter-Mickelsen, hereinafter referred to as the “Developer”, have a current development agreement for the Nature Haven Subdivision, and

 

            WHEREAS, the Developer never proceeded with development of the Nature Haven Subdivision, and

 

            WHEREAS, there are no outstanding fees owed by the Developer and the City has closed all files and project numbers pertaining to the Nature Haven Subdivision.

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Nature Haven Subdivision development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 14th day of February, 2005.

 

            Passed and adopted this 14th day of February, 2005.
