Recommendation: That the Common Council adopt Resolution No. 10468-021405, a resolution approving a public water main easement from Thomas W. Jungck, 13501 W. Green Meadows Drive, New Berlin, WI, 53151 for the proposed public water main easement at 10590 S. Emerald Meadows Drive, Oak Creek, WI, 53154 (Tax key No. 961-9993-002) (5^th Aldermanic District).

Background: The proposed public water main easement, and the associated water main, provides water main service to the new Deerfield Elementary School, now under construction. The water main proposed to go in this water main easement is a part of the overall water main system for the proposed Emerald Meadows Addition No. 2 Subdivision. This proposed subdivision and its associated utilities, i.e. sewer and water, may not be available for the new school’s Fall 05 opening thus the need to proceed at this time to ensure that water main service is in and operating for the new school.

Fiscal Impact: None. Project is Developer funded.

RESOLUTION APPROVING A PUBLIC WATER MAIN EASEMENT

AT 10590 S. EMERALD MEADOWS DRIVE

(TAX KEY NO. 961-9993-002)

(5^th ALDERMANIC DISTRICT)

WHEREAS, Thomas W. Jungck is said owner of lands at 10590 S. Emerald Meadows Drive, Oak Creek, WI, 53154 and,

WHEREAS, the City of Oak Creek Water and Sewer Utility requires that the Owner of said lands enter into a Public Water Main Easement agreement for the extension of public water main to service the Deerfield Elementary School, and

WHEREAS, the required Public Water Main Easement agreement has been prepared and signed by the Owner,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached Public Water Main Easement agreement, as signed by the Owner, is hereby approved by the City.

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached agreement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
