Recommendation: That the Council approve the request by Reinhart Foods for a special exception to the 27th Street development moratorium.
Background: Reinhart Real Estate Group is requesting a special exception to the 27th Street development moratorium (assuming that it is extended) to allow for the division of the property at 9950 S. 27th Street into one lot and two outlots. It is anticipated that the outlots will eventually be joined with the property at 9950 S. Reinhart Drive, which is being sold to another party.
There are no imminent building plans for the vacant portions of this land division. However the applicants have indicated that this division must be recorded as a condition of the sale of the business. The now vacant 27 acres along S. 27th Street would remain intact, and would be available for future development in accordance with the corridor plan.
The moratorium ordinance allows the Common Council to authorize special exceptions, after a recommendation by the Plan Commission, in instances where there has been a demonstrated hardship and compelling public interest and circumstances of necessity or fairness or equity for considering approving the request prior to the expiration date of the moratorium.
The Plan Commission has reviewed this request, and has recommended that the special exception be granted.
Fiscal Impact: The granting of a special exception would allow for the division of property necessary to finalize the sale of this business.
