Recommendation: That the Council adopt Ordinance No. 2383, which would rezone the properties at 8081, 8131 and part of 8201South Howell Avenue from M-1, Manufacturing to B-4, Highway Business and authorize the issuance of a conditional use permit for a gasoline service station with an oil lube facility and car wash.
Background: The applicant is requesting that the properties at 8081, 8131 and part of 8201S. Howell Avenue be rezoned from M-1, Manufacturing to B-4, Highway Business and that a conditional use permit be issued for a gasoline service station with an oil lube facility and car wash. This rezoning is being requested to allow for the eventual construction of a Woodman’s grocery store and gasoline station as well as the potential future development of additional retail along S. Howell Avenue and W. Forest Hill Drive.
A conceptual development plan of the property is presented as an attachment to this staff report. Detailed site, building, and landscaping plans will be presented to the Plan Commission at a later date, provided the rezoning and conditional uses are approved.
A neighborhood meeting was held regarding the proposal. The main concern with the project was the location of the gas station which, at that time, was located along Howell Avenue. Based on the comments received at that meeting, and previously through City staff, the gas station was relocated to the interior of the property.
The Plan Commission has recommended approval of this rezoning and conditional use subject to the included conditions and restrictions. Those conditions and restrictions, which were prepared using the input obtained at the Plan Commission and informational meeting contain (in addition to some of the City’s standard language) provisions regulating the setback of the gas station, the hours of operation, the architecture of the gas station. It also establishes a longer time period (three years) for the commencement of the conditional use. This was done to allow ample time for any demolition and environmental remediation that may need to take place.
